dc.description.abstractINTRODUCTION|In Selective Service System v. Minnesota Public Interest Research Group, the United States Supreme Court determined that the federal government may deny financial assistance to male college students who have not complied with the law requiring them to register with the Selective Service System. The denial was first challenged by a corporation representing the interests of such college students and later by several students who would in fact be affected by the new law. Section 1113 of the Department of Defense Authorization Act of 1983 denies federal financial assistance under Title IV of the Higher Education Act of 1965 to male students between the ages of eighteen and twenty-six who fail to register for the draft. The Act was challenged on the grounds that it constituted a bill of attainder and that it violated the privilege against self-incrimination granted under the fifth amendment. The Court held that section 1113 was neither a bill of attainder nor a violation of the fifth amendment privilege against self-incrimination. This Note examines Selective Service System in light of previous decisions dealing with bills of attainder and the privilege against self-incrimination.
